La acción civil no podrá proponerse ante el juez civil cuando en el proceso penal se haya declarado, por sentencia definitiva o por auto de sobreseimiento definitivo que estén ejecutoriados, que la infracción en que aquélla se funda no se ha realizado, o que el sindicado no la ha cometido o que obró en cumplimiento de un deber o en ejercicio de una facultad legítima.
