CAPTURA FACULTATIVA. En los procesos por delitos sancionados con pena de prisión cuyo mínimo sea o exceda de dos (2) años, podrá librarse orden escrita de captura contra el imputado para efectos de la indagatoria. De la misma manera se procederá cuando se investigan delitos que atenten contra el servicio, la disciplina, el honor, o cuando se haya proferido en contra de la persona que deba ser indagada medida de aseguramiento, de caución o detención en otro proceso.
