Cuando el actor, en la segunda instancia por apelación de la sentencia, abandona el juicio durante un año, el Juez declara a petición del opositor, ejecutoriada la providencia materia del recurso.

Son aplicables, en lo pertinente, a esta incidencia las reglas dadas en el artículo anterior.
