Artículo cuarenta y seis. Si el impedimento o recusación se presentare en la etapa del sumario con relación al funcionario instructor que no fuere competente para conocer del proceso, resolverá el incidente el Juez del conocimiento. Si lo declara fundado, el Juez competente continuará la instrucción por si o por medio de comisionado. Si el impedimento o recusación se presentare durante el juicio, se suspenderá este hasta cuando se decida el incidente. CAPITULO CUARTO Cambio de radicación de los procesos penales .
