Las infracciones cometidas por personas que gocen de normalidad psíquica son intencionales o culposas.

Hay culpa cuando el agente no previó los efectos nocivos de su acto habiendo podido preverlos, o cuando a pesar de haberlos previsto, confió imprudentemente poderlos evitar.
