°. Responsabilidad penal. Para efectos de la responsabilidad penal prevista en el artículo 125 de la Ley 488 de 1998, el funcionario competente del área de cobranzas de la Secretaría de Hacienda del ente territorial o de la Dirección de Apoyo Fiscal, procederá a instaurar la denuncia penal ante la autoridad competente. En caso de incumplimiento en el pago por parte de los distribuidores minoristas, el distribuidor mayorista, productor o importador, según el caso, presentará la denuncia respectiva aportando las correspondientes facturas de venta y la identificación del sujeto incumplido.
