La acción penal del delito previsto en el artículo 40 solo podrá iniciarse a solicitud de la persona ofendida o de la quien represente legalmente. Si aquella fuere menor y no tuviere representante legal, la querella puede ser presentada por el Defensor de Menores.
Una vez iniciada la acción penal no hay lugar al desistimiento de que trata el Artículo 102 del Código Penal, salvo en el caso previsto en el Artículo 42 de la presente Ley.
