LEGISLACIÓN ANTERIOR

Artículo 2.2.9.7.7.3. Causales de no imputabilidad por incumplimiento de las obras incluidas en el Plan de Saneamiento y Manejo de PSMV. Son causales de no imputabilidad por incumplimiento de las obras incluidas en el Plan de Saneamiento y Manejo de Vertimientos (PSMV) las siguientes:

Fuerza mayor o caso fortuito, acorde con lo establecido en el artículo 1° de la Ley 95 de 1890.

Hecho de un tercero.

Parágrafo

Para todos los efectos del presente decreto el prestador no podrá alegar el hecho de la víctima como causal de no imputabilidad.
