Según lo dispuesto en el artículo 683 del Decreto 1298 de 1994, a partir del 23 de diciembre de 1993 no podrá reconocerse ni pactarse para los nuevos servidores del sector salud retroactividad en el régimen de cesantía a ellos aplicable. Quienes se hayan vinculado con anterioridad a dicha fecha y gocen de la retroactividad de las cesantías, podrán optar por el régimen no retroactivo de liquidación anual de cesantías, teniendo un incremento del quince por ciento (15%) sobre la asignación básica mensual que se encuentren devengando.
