º. En los procesos penales en curso por los delitos a que se refiere el artículo 5º y cuando existan sindicaciones contra cualquier persona que esté o no vinculada a ellos, el Juez del conocimiento decretará de oficio la extinción de la acción penal, mediante providencia motivada, siempre que se reúnan los demás requisitos exigidos en este Decreto.
