El artículo 313 del Código Civil quedará así: La emancipación voluntaria se efectúa por instrumento público, en que los padres declaran emancipar el hijo adulto y este consciente en ello. No valdrá esta emancipación si no es autorizada por el juez con conocimiento de causa.
