Declaratoria de contumacia del procesado. Si el procesado estuviere debidamente identificado, transcurridos cinco días contados a partir de la fecha de expedición de la orden de captura, no hubiere sido aprehendido o no hubiere comparecido voluntariamente, se l e declarará, en rebeldía, se le nombrara defensor de oficio y se proseguirá la investigación hasta su culminación.
