Art. 45. En casos de calumnia o injuria contra particulares, es necesario la acusación de la parte agraviada para iniciar el procedimiento.

En tratándose de injuria o calumnia a Corporaciones públicas, es menester para que pueda iniciarse el procedimiento criminal respectivo, la presentación de queja formal de quien presida, para lo cual debe proceder de acuerdo con los miembros de la Corporación, si es deliberante.
