si el que es demandado por cosa que no posee lo expresa así al Juez, se sustancia esta excepción dilatoria, comprendida en la de inepta demanda; y si se sentencia a favor del demandado, queda exento de la demanda, a no ser que sea el ladrón o estafador de la cosa demandada, o que dolosamente la haya enajenado para hacer más difícil la gestión del actor.
