En el discernimiento de la guarda testamentaria, la elección de la persona o personas que deben desempeñar la legítima y el nombramiento de los guardadores dativos, el Juez procede ciñéndose a las reglas dadas en el Código Civil, y con conocimiento de causa; esto es, por el mérito de las pruebas y después de oír a las personas o funcionarios que dicho código designa.
