Los gastos de arribada forzosa provenientes de hechos que constituyen averías comunes o particulares se regirán por lo dispuesto en el Capítulo Primero de este Título.

Salvo el caso de avería común, los gastos de la arribada ilegítima, serán de la responsabilidad del armador sin perjuicio de su derecho para repetir contra la persona que haya ocasionado la avería.
