º Para efectos de lo dispuesto en el artículo 70 de la Ley 38 de 1989 hay faltante de apropiación en gastos de funcionamiento cuando lo previsto para tal fin en la respectiva ley anual sea insuficiente, evento que incluye el caso en el cual el legislador haya creado un organismo o entidad con posterioridad a la expedición de la ley anual de presupuesto para la respectiva vigencia.
