El artículo 53 del Decreto 80 quedará así: " La creación de instituciones oficiales corresponde al Congreso Nacional, a las Asambleas Departamentales, a los Consejos Intendenciales, a los Consejos Comisariales y a los Concejos Municipales, a iniciativa del Ejecutivo, con el cumplimiento de las exigencias señaladas para el efecto. Al respectivo proyecto de ley, ordenanza, acuerdo intendencial, comisarial o municipal, deberá acompañar la autoridad ejecutiva correspondiente el estudio de factibilidad debidamente aprobado por el ICFES, que acredite la conveniencia de crear la institución2.
