El Notario no responde de la capacidad de los otorgantes. Sin embargo, si le constare que cualquiera de ellos es relativamente incapaz, así lo advertirá; y si no obstante insistiere en el otorgamiento, el Notario autorizará el instrumento, dejando de él la debida constancia de la advertencia hecha a los otorgantes y de la insistencia de éstos. Pero si se tratare de absolutamente incapaces, el Notario no prestará el servicio. El Notario responde de que los testigos testamentarios y de abono reúnen las condiciones exigidas por la ley.
