º. La contravención a lo dispuesto en los artículos anteriores producirá la vacante del cargo. A solicitud de cualquier ciudadano, el Consejo de Estado, en Sala Plena, hará la declaración de vacancia cuando se trate de Senadores o de Representantes, y el respectivo Tribunal Administrativo, dando aplicación a lo dispuesto en el artículo 24 del Decreto 2046 de 1950, hará dicha declaración cuando se trate de Diputados o de Concejales.
