Los expendedores de tabaco están oblados a llevar un diario de ventas, en el cual harán constar la fecha, nombre del comprador y la cantidad de tabaco vendida, y a exhibir dicho libro al Recaudador, Teniente o Jefe del Resguardo, cuando éstos lo soliciten. La omisión o resistencia al cumplimiento de este deber acarreará al responsable una multa de $ 5 oro, sucesivamente impuesta, hasta obtener el cumplimiento. Exceptúanse de esta formalidad los vendedores en los puestos públicos de los mercados y los vendedores de tabaco elaborado en pequeña escala.
