º Si el acusado negare el cargo, no siendo notoria la falta u ofreciere presentar pruebas que justifiquen su conducta, el funcionario que conozca del asunto pondrá el hecho en conocimiento del Ministerio Público y señalará un día, que no sea antes de los tres ni después de los ocho siguientes, para que se presenten las pruebas ofrecidas ó pedidas, tanto por parte del acusado como por la del Ministerio Público.
