Cuando el Procurador General de la Nación o el Fiscal General de la Nación, en desarrollo de investigaciones adelantadas en ejercicio de sus funciones, establezcan la existencia de las conductas a que se refiere el artículo 82 de esta Ley, solicitará a la autoridad competente que declare la caducidad del contrato, con base en las circunstancias que señalen dichos funcionarios en su solicitud.
