Por razones de soberanía nacional, decláranse de utilidad pública las tierras o zonas costeras del Archipiélago de San Andrés y Providencia. Las propiedades adquiridas con violación del artículo 5o. del Decreto 1415 de 1940, podrán ser expropiadas, por razones de equidad, sin indemnización previa, de conformidad con el artículo 30 de la Constitución Nacional.
