°. La presentación para la aceptación se excusa y la letra puede ser considerada como rechazada por no aceptación, en cualquiera de los casos siguientes:

1° Cuando el girado ha muerto o se oculta o es una persona supuesta, o no tiene capacidad para contratar;

2° Cuando no puede hacerse la presentación después de una razonable diligencia, y

3° Cuando la aceptación se haya rehusado en cualquier otra forma, aunque la presentación haya sido irregular.
