De Acuerdo Con El Artículo 19 De La Constitución Política Esta Protección Se Brindará De Preferencia Al Menor Necesitado

De acuerdo con el artículo 19 de la Constitución Política esta protección se brindará de preferencia al menor necesitado. Entendiéndose por tal el menor que carece de la protección familiar; el que dependa económicamente y socialmente de personas que estén incapacitadas física, moral o mentalmente y de las privadas de libertad a causa de detención o penas legales.

Parágrafo 1

La atención y protección especiales del menor enfermo corresponde a las instituciones que por ley, reglamento, contrato, etc., cumplen esas funciones.

Parágrafo 2

Al ICBF corresponde inspeccionar y vigilar la actividad de las entidades o personas naturales que presten asistencia al menor y a la familia.
