Los Oficiales y Suboficiales de la Policía Nacional serán retirados del servicio por incapacidad profesional cuando

No opten el título universitario respectivo en un término de cuatro (4) años, a partir de la fecha de su escalafonamiento, si se trata de Oficiales de los Servicios que requieren este requisito.

No obtengan calificaciones aprobatorias en un segundo examen o curso de capacitación profesional exigido para el ascenso.

Sean clasificados en lista número 5, de acuerdo con el Reglamento de Calificación y Clasificación del Personal de la Policía Nacional.
