El que en combate o en presencia del enemigo entregue, deje tomar elementos de guerra o se retire, capitule, rinde la fuerza, plaza, buque, nave aérea, puesto o punto fortificado cuyo mando tiene, sin ser obligado por fuerzas incontrastablemente superiores en número, armamento o posición, siempre que los hechos no constituyan un delito más grave, incurre en presidio de tres a catorce años.
