El Ministro de Educación Nacional, a través del Instituto Colombiano para el Fomento de la Educación Superior (Icfes), podrá ordenar la apertura de investigación preliminar con el objeto de comprobar la existencia o comisión de los actos constitutivos de falta administrativa señalados en el artículo anterior. Corresponde al Instituto Colombiano para el Fomento de la Educación Superior (Icfes), llevar el registro de las sanciones impuestas y adoptar las medidas conducentes para que ellas se hagan efectivas.
