Los trabajadores obligados por una convención colectiva tienen acción para exigir su cumplimiento o el pago de daños y perjuicios, siempre que el incumplimiento les ocasione un perjuicio individual. Los trabajadores pueden delegar el ejercicio de esta acción en su sindicato.
