Al aplicar las disposiciones de los incisos 1° y 2° del artículo anterior; no se deben tener en cuenta las contravenciones, los delitos culposos, los delitos contra la disciplina militar, incendio, saqueo o robo, el homicidio y las heridas cuando ha mediado provocación, o exceso en la defensa o en el estado de necesidad, y los delitos cometidos por menores de diez y ocho años.
