Art. . 408. En la pérdida o avería de buques a la entrada o salida del puerto, procederá el Jefe del Resguardo a tomar declaracion al Capitan i dos individuos mas de la tripulacion del buque perdido o averiado, como tambien a tres Capitanes, prácticos o personas que hayan presenciado la pérdida o avería.

Estas declaraciones tendrán por objeto fijar la causa de la pérdida o avería, i la responsabilidad o culpabilidad del Capitan, conservando estas dilijencias orijinales para los efectos legales.
