Guando no se hallare sino parte o despojos de la res hurtada o robada y por ello no se pudiere determinar bien el tamaño y calidad para establecer su valor, éste, para los, efectos de la aplicación de la pena, se estimará por el de una res de la misma especie, de tamaño común y de regular calidad. El avalúo lo practicarán peritos nombrados por el Juez.
