Cuando un funcionario comisionado se halle legalmente impedido, ha de pasar la comisión a quien deba reemplazarlo, sin que sea necesario, para que éste la cumpla, que se declare previamente separado al Juez que se haya manifestado impedido. Pero si el impedimento manifestado no es cierto, el funcionario incurre en las sanciones establecidas en la ley penal.
