Las sentencias definitivas y los autos interlocutorios con fuerza de sentencia definitiva que se profieran contra el estado, los Departamentos, los Municipios, el Lazareto, deben consultarse con el superior, cuando lo haya. En el fallo mismo debe ordenarse la consulta.

También deben consultarse los fallos en que se procede de oficio.
