Los militares, colombianos o extranjeros, al servicio del Ejército, que incurrieren en alguno de los delitos contemplados en el artículo 195 del Código Penal, serán castigados con la pena de quince años de reclusión militar, si fueren jefes o capitanes de los piratas; si no lo fueren, serán castigados con la pena de diez a quince años de reclusión militar.
