Preferencia sobre inmuebles entregados en dación en pago . Cuando dos o más personas manifiesten al establecimiento de crédito su intención de celebrar un contrato de los previstos en el presente Título respecto de un inmueble, aquella que lo hubiese entregado a título de dación en pago tendrá preferencia para la suscripción siempre y cuando su capacidad de pago se lo permita.
