Artículo décimo. Para efectos de lo dispuesto en el Artículo 5o. del presente decreto, se tendrá en cuenta lo preceptuado por el Artículo 40 de la ley 153 de 1887.

Parágrafo

los negocios penales de que actualmente conoce la Justicia Penal Militar y por razón del presente decreto han dejado de ser de su competencia, pasarán inmediatamente a la justicia ordinaria o la jurisdicción correspondiente en el estado en que se encuentren cualquiera que sea la entidad que este conociendo de ellos.
