Si el auto de calificación es de sobreseimiento, después de notificado a las partes se archiva el expediente. Si el auto de calificación es de proceder, después de notificado a las partes, se ordena dar traslado del expediente, por el término de doce horas, primero al fiscal y luego al defensor del sindicado.
