º Modificar el artículo 34 del Decreto 1706 del 1º de agosto de 1989, el cual quedará así: PLAZO PARA LA ENTREGA DE FUNCIONES. Las funciones asignadas en el artículo 9º de la Ley 29 de 1989, sólo podrán ejercerse a partir de la fecha en que el Ministerio de Educación Nacional efectivamente entregue la planta de cargas docentes y administrativos a los municipios.

Parágrafo

En los municipios que no tengan la capacidad financiera y/o administrativa, las funciones asignadas a los Alcaldes serán asumidas temporalmente por los Gobernadores, Intendentes y Comisarios en los términos establecidos en el artículo 10 de la Ley 29 de 1989.
