ARTICULO 26 . Distribución de Competencias. - Las funciones de la misma naturaleza atribuidas al Superintendente Nacional de Salud y a los Superintendentes Delegados Seccionales, se ejercerán conforme a las siguientes reglas de competencia

1.

Por regla general, el ejercicio de las funciones corresponde en primera instancia a los Superintendentes Delegados Seccionales y en segunda instancia al Superintendente Nacional;

2.

Excepcionalmente corresponde el ejercicio de las funciones en única instancia al Superintendente Nacional en los siguientes casos: 1) Cuando los Superintendentes Delegados Seccionales se declaren impedidos o sean recusados conforme a la Ley; 2) Cuando a juicio del Superintendente Nacional las materias objeto del ejercicio de las funciones transciendan la jurisdicción territorial de una Superintendencia, o sean calificadas de carácter especial mediante acto administrativo debidamente motivado; 3) Cuando se trate de asuntos relativos a la organización central o a la dirección general de las entidades del orden nacional.
