No aceptación de la pretensión. Si el Juez considera fundada la petición, enviará la actuación al funcionario que estime competente. En la misma forma procederá cuando de oficio un funcionario se declare incompetente para seguir conociendo de un proceso. Si el funcionario que recibe la actuación está de acuerdo, aprehenderá el conocimiento, en caso contrario, enviará el expediente a la autoridad que deba resolver el conflicto para que, de Plano fije la competencia.
