El testamento cerrado, antes de recibir su ejecución, debe ser presentado al Juez para que proceda a su apertura en la forma establecida en el artículo 1082 del Código Civil.

La petición de apertura se hace por escrito, y se acompaña de la prueba de la muerte real o presunta del testador y del pliego que contiene el testamento, cuando éste no se encuentre ya en poder del funcionario que va a abrirlo.
