Son autoridades portuarias el Consejo Nacional de Política Económica y Social, quien aprueba o imprueba los planes de expansión portuaria que le presente el Ministerio de Obras Públicas y Transporte; el Ministro de Obras Públicas y Transporte quien programa, evalúa y ejecuta en coordinación con la Superintendencia General de Puertos, los planes de expansión portuaria aprobados por el CONPES. Cuando se considere necesario, la Superintendencia General de Puertos, ejercerá sus funciones en coordinación con la Dirección General Marítima del Ministerio de Defensa Nacional.

Parágrafo

los capitanes de puerto de la Dirección General Marítima ejercerán exclusivamente las funciones de autoridad marítima.
