En caso de incumplimiento de lo dispuesto por el artículo anterior, el funcionario aduanero correspondiente pasara informe detallado al superior jerárquico del infractor para la aplicación de la sanción de separación por mala conducta o de destitución, según el caso, de que trata el artículo 5° del Decreto 3134 de 1952, sin perjuicio de la sanción penal ordinaria a que hubiere lugar.
