Todo individuo que sin permiso de la autoridad y sin motivos ilícitos fabrique, use o conserve instrumentos o maquinas explosivas de cualquier clase, será castigado con la pena de uno a tres años de presidio. El sindicado por este delito no tendrá derecho a excarcelación, y podrá ser detenido accidentalmente por el funcionario de instrucción. El procedimiento en este caso será el establecido en el Artículo 4º de esta Ley.
