Si el actor justifica su derecho, el Juez dispone que el demandado se abstenga de ejecutar los actos en que consiste la perturbación os e funda el temor, so pena de pagar al actor una indemnización de cincuenta a quinientos pesos,según la gravedad e importancia del caso, al prudente arbitrio del mismo Juez, por cada acto o hecho subsiguiente, sin perjuicio de la indemnización civil común y la responsabilidad criminal en que incurra.
