Orden Ilegítima

La orden es ilegítima cuando excede los límites de la competencia o conduce manifiestamente a la violación de la Constitución Política, la ley, los derechos humanos, las normas institucionales o las .órdenes legítimas superiores.

Parágrafo

Si la orden es ilegítima, el subalterno no está obligado a obedecerla. En caso de hacerlo la responsabilidad recaerá sobre el superior que emite la orden y el subalterno que la cumple -o ejecuta.
