Si el juez o magistrado en quién concurra alguna de las causales de recusación no se declarare Impedido, cualquiera de las partes podrá recusarlo en cualquier estado del proceso, hasta cinco días antes de la celebración de la audiencia.

La recusación se propondrá por escrito, ante el Juez que conoce del asunto, acompañando las pruebas y exponiendo los motivos en que se funde.
