Los excedentes de las muestras tomadas para la practica de que prueba pericial serán enviados al instituto de medicina legal de Bogotá cuando la pruebas periciales sean practicadas por éste, los excedente permanecerán es esa institución. En todo caso, los excedentes depositados en el instituto de medicina Legal de Bogotá, permanecerán a disposición del Juzgado de conocimiento hasta cuando se dicte sentencia de primera instancia, sobreseimiento definitivo o cesación de procedimiento, después de lo cual las sustancias podrán ser utilizadas para fines lícitos o destruidos, según lo disponga el Consejo Nacional de Estupefacientes.
